Term & Condition between
- The Agent - Seller - Buyer :
The land : The land / property, detailed
overleaf, which will be marketed by the agent.
The Clients: Is a persons who is introduced by the agent and
who intends to acquire the land / property.
The Seller : Is the persons who signs the listing
agreement overland and who instructing griyasari property to
market the land / property.
The Seller:
Must be the legal owner or have legal
contract with the nominee title order of the land / property and
they canīt alter selling price of the land / property without informing the
agent. The seller agree to produce all document to verity his / her legal right to sale / lease the land / property
upon request the agent whilst marketing and introducing the land / property to the clients. The seller
confirm that all government taxes on the land / property have been fully paid to the legal authorities. The seller
confirm that the 3rd ( third ) party, other than the
nominee titleholder, has title to land / property. The seller is
prohibited from making direct approaches to the clients, unless
approved, in writing by the agent. The seller is encouraged to
inform the agent, at any time, if the seller to terminate the
marketing of the land / property undertaken by the agent. This
notification must be made in the form of a letter, facsimile or
email.The seller must also inform to the agent if and when the
land / property has been sold / leased or is writhdraw from the
market. If the seller has appointed the agent to market the land
/ property as "sole agent ", the agent is contracted
to list the land / property for 90 days from the date of this
agreement. During this period all inquires, from the date of
this " listing agreement " must be handled by the
agent. The seller is prohibited from dealing with other agents
or 3 rd ( third ) parties whilst the land / property is listed
as " sole agent " status with the agent.
All inquiries for the land / proprety must be passed to
the agent. The seller may not revoke the entitled to earn
commission ( detailed overleaf ) from the seller if th eland / property is
sold within the timeframes of this agreement, by any means.
The owner: confirms that all relevant detailes have been
recorder on the "listing agreement" and are correct
and accurate. It is the owners responsibility to inform the
agent, in writing of any changes to the details conteined in the
" listing agreement".
The agent is not liable to action taken by the client arising
from informations which has not been supplied to the agent,
either in writing or conteined in the " listing
agreement" by the seller.
The Agent: The agent ( griyasari ) property office
appointed by the seller to market the land / property. The agent
is licensed franchise holder of "Griyasari Property."
Upon signature
overleaf, the agent has hereby been appointed by the seller to
market the land / property on the basis described in the "
listing agreement". The agent , on behalf of the seller,
will conduct all negotiation with the clients.
The agent is not liable for any action taken by the clients as a
result of wrong or misleading information supplied by the seller
to the agent.
The Agent will earn commmissions from the seller of the land /
property once the agent has completed the sale / lease
transaction of the land / property. The amount of the
commissions is detailed in the " listing agreement "
and will vary proportionately if there is a change in the agreed
selling price paid by the clients.
The agent is entitled to receive the commission within 7 days of
transaction. If the client pays deposits for the land / property
and subsequently fails to complete the transaction, thereby
losing the deposit, the agent is entitled to receive 50% of the
deposit from the seller. ( agreed % to the agent if different
.............% )
The agent accepts no
liability if the agent fails to secure the sale of the land /
property.
The agent recommeds that the seller engage independent legal
advise in connection with the sale of the land / property.
This "listing
agreement" is only valid once signed by the seller and the
agent. In the case of a "multiple agent listing"
the agreement is valid for 12 months.
If the sale / lease
of the land falls through due to incorrect or incomplete
information supplied to The agent by the seller,
the agent is entitled to a payment from the seller equal to the
cost incurred by the agent whilst marketing and introducing the
land to the clients.
Any disputes arising
from breaches of this " listing agreement" are subject
to the laws of the Republic of Indonesian and will ultimately be
settled in government court at Denpasar, Bali , Indonesia.
